CONDITIONS OF SALE
GENERAL CONDITIONS:
Orders sent by the customer to Enoteca Obsequium must be completed in every single part to allow the products to be shipped to the place indicated. Enoteca Obsequium undertakes to send an email to the customer with the receipt of the order placed; it will be the responsibility of the latter to check for any errors in the order information and promptly communicate them to the staff. Enoteca Obsequium reserves, at its sole discretion, the right to accept or refuse orders received. Enoteca Obsequium guarantees that products identical to those indicated on the site will be delivered.

AVAILABILITY OF PRODUCTS
Enoteca Obsequium, by e-mail, will inform the Buyer if the requested good is no longer available or what are the waiting times to obtain the chosen good, asking if it intends to confirm the order or not or to receive products of the same value in sostitution. The computer system confirms as soon as possible the registration of the order by sending the user a confirmation by e-mail, which does not produce any legal obligation, being a simple summary of the order.

LIMITATION OF LIABILITY
Enoteca Obsequium assumes no responsibility for disservices attributable to force majeure, if it fails to execute the order within the time stipulated in the contract; shall not be held liable to the Purchaser, except in the case of willful misconduct or gross negligence, for disservices or malfunctions connected to the use of the internet outside of its own control or that of its sub-suppliers; it will also not be liable for damages, losses and costs suffered by the Buyer as a result of the non-execution of the contract for reasons not attributable to him, since the Buyer is only entitled to a full refund of the price paid; assumes no responsibility for any fraudulent or illegal use that may be made by third parties, of credit cards, upon payment of the purchased products, if it proves that it has adopted all the ordinary possible precautions of the moment and based to ordinary diligence.

BUYER'S OBLIGATIONS
The Buyer undertakes to pay the price of the purchased goods within the times and methods indicated in the Contract. The Buyer undertakes, once the online purchase procedure has been completed, to print and keep the web page containing the order data. The information contained in this contract has, moreover, already been viewed and accepted by the Buyer, who acknowledges it, as a reference to this web page is shown at the time of finalizing the order.

RIGHT OF WITHDRAWAL
(ART. 5 D.LGS 185/99) The CUSTOMER has the right to withdraw from the contract stipulated remotely, without any penalty and without specifying the reason, promptly communicating the cancellation within 15 days from the order placed by e-mail to the address info@obsequium.it before having received confirmation as previously provided, or before the goods have been shipped. If the goods have already been delivered, the right of withdrawal is exercised by sending, within 15 working days from the day of receipt of the goods, a registered letter with acknowledgment of receipt to the address of our office at the Enoteca Obsequium in via Borgo San Jacopo 17, 50125 Florence. This communication must contain the data necessary to accurately identify the order, the clear will to renounce the purchase and the product or products for which it is intended to exercise the right of withdrawal. The CUSTOMER is required to keep the original packaging of the product and to return the goods as quickly as possible. In this case, the only costs payable by the consumer for exercising the right of withdrawal are the direct costs of returning the goods to the sender, the costs for packaging the product to be returned which must be returned intact. Enoteca Obsequium, on the other hand, undertakes to reimburse the CUSTOMER as soon as possible the sums paid by them as payment of the price, without additional costs, and in any case within thirty days from the date on which, becoming aware of the exercise of the right of withdrawal by the CUSTOMER, receives the ordered goods, intact, at the following address: via Borgo San Jacopo 17, 50125 Florence. The CUSTOMER cannot exercise the right of withdrawal in the event that the failure to collect the ordered goods is attributable to the absence of the CUSTOMER from the place of delivery or, in any case, to his delay or negligence.

COMMUNICATIONS AND COMPLAINTS
Pursuant to art. 12 of Legislative Decree 70/03, Enoteca Obsequium informs the Buyer that each order sent is stored in digital form on the server where the site resides according to criteria of confidentiality and security.

ARCHIVING METHOD OF THE CONTRACT
Written communications directed to Enoteca Obsequium and any complaints will be considered valid only if sent to Enoteca Obsequium, via Borgo San Jacopo 17, 50125 Firenze or sent by e-mail to info@obsequium.it. The Buyer indicates in the registration form his residence and domicile, the telephone number or the e-mail address to which he wishes the communications to be sent.

DURATION AND EFFECTIVENESS OF THE CONTRACTUAL CONDITIONS
The confirmation of the order implies for the Buyer the acceptance of these general conditions. These conditions may be updated or modified directly with the transcription of the new rule on this site. The modification or update will be valid and effective for orders that have not yet been entered and for which the web page, which summarizes the order data, has not yet been displayed and printed.
